General Terms and Conditions of Sale (GTC)
Article 1: Scope
These general terms and conditions apply to all services (repair, maintenance and diagnosis of household appliances) agreed between MaB Repair, hereinafter referred to as “the Service Provider”, and the customer, hereinafter referred to as “the Customer”. Acceptance of a quotation or a request for a service call implies unreserved acceptance of these terms and conditions.
Article 2: Services and Quotations
- Services are mainly provided at the client’s home or, if necessary, in the workshop.
- A diagnostic check is carried out before any major repairs are undertaken.
- If the Customer refuses the repair following the diagnosis, the call-out and diagnosis charges previously quoted will still be payable.
- Quotations are valid for 30 days from the date of issue.
Article 3: Prices and Terms of Payment
- Prices are shown in euros, inclusive of all taxes (TTC) for private customers, or exclusive of VAT (HTVA) for business customers.
- Payment is due in cash or via online payment at the end of the service, unless otherwise agreed in writing in advance.
- In the event of late payment by a consumer customer (private individual), an initial reminder will be sent free of charge. If payment is not made within the statutory period of 14 days, late payment penalties and fixed compensation will be applied in accordance with current Belgian legislation.
- Spare parts ordered specifically for the Customer may be subject to a deposit before work begins.
Article 4: Provision of Services
- The Service Provider undertakes to take all necessary steps to repair the appliance, but is bound only by an obligation of means, and not of result, in the event of complex faults or obsolete appliances.
- If a device brought to the workshop proves to be beyond repair, the Customer has 30 days to collect it. After this period, the Service Provider reserves the right to dispose of it or recycle it, without any compensation to the Customer.
Article 5: Repair Warranty
- The Service Provider provides a contractual guarantee valid for 1 month (30 calendar days) from the date of invoicing for the work carried out.
- This warranty covers only the labour and parts replaced during the initial repair.
- This warranty applies only if the recurring fault is exactly the same and/or caused by the previous repair.
- The following are expressly excluded from this warranty: new or different faults, problems caused by the Customer’s misuse of the equipment, normal wear and tear, or any work carried out by a third party after the Service Provider’s visit.
Article 6: Liability
- The Service Provider accepts no liability for indirect or consequential damage (loss of contents from a freezer, prolonged water leakage after use, etc.).
- The Customer is responsible for ensuring safe and unobstructed access to the faulty appliance.
- In the event of proven direct damage caused by the Service Provider, the latter’s liability shall be limited to the amount invoiced for the service.
Article 7: Right of Withdrawal (For private individuals)
- In accordance with Belgian law, the Customer has 14 days to withdraw from a contract concluded at a distance or off-premises.
- However, the right of withdrawal cannot be exercised if the Customer has expressly requested the Service Provider to visit their home to carry out urgent maintenance or repair work, and/or if the service has been fully performed within that period.
Article 8: Disputes and Applicable Law
- These terms and conditions are governed by Belgian law.
- In the event of a dispute, the parties undertake to seek an amicable resolution.
- In the absence of an agreement, the courts of the judicial district in which the Service Provider’s registered office is situated shall have exclusive jurisdiction.
- In the event of a dispute, or in the event of any discrepancy in interpretation between different language versions, the French version shall prevail.
